Question Description
White-collar crime is any business-related act that uses deceit, deception, or dishonesty to carry out criminal enterprise. These types of crimes are characterized by fraud, concealment, or a violation of trust. One type of white-collar crime is chiseling. Chiseling is an ongoing conspiracy to use one’s business or business position to cheat institutions or individuals by providing them with faulty or bogus goods and services or by providing services that violate legal controls on business practices.
In a press release by the DOJ Friday, May 10, 2019. Five individuals plead guilty in connection with an organic fraud scheme that totaled nearly $140 million in fraudulent sales. One of the perpetrators admitted that grain grown on non-organic fields was marketed and sold as organic and that substances that were not approved were used on fields certified as organic.
This case constitutes chiseling because the business marketed products and deceived buyers into thinking the grain products were organic. The sale of the grain also violated legal controls as unapproved substances were used on the fields that were certified as organic. One of the individuals made sales through a brokerage firm that he owned. The vast majority of those sales were fraudulent.
